The works council (in French, Comité social et économique) plays an important role in the life of a company. It can take many forms, and its mode of operation can vary from one context to another.

The works council is a legal entity. Its identity, culture, and actions are determined, in particular, by the sector in which the company operates, the electoral weighting of the various colleges of employees, the presence of trade unions, and the organizational structure of the company concerned.

Long-term advice on the day-to-day business of works councils

Since our creation, we have worked alongside our clients to assist and advise them on the day-to-day running of their works councils. As such, we help with complex electoral processes and with the contractual implementation or judicial recognition of social and economic units.

We conduct audits of economic and labor-related databases, and help our clients plan and organize the mandatory annual consultation processes.

We draft works council internal rules and regulations, and agreements with regard to their mode of operation. We help our clients with the longitudinal follow-up of agenda items for official meetings, and in reviewing meeting minutes, etc.

We support clients with ad hoc consultations concerning the future of the company (reorganizations, disposals, acquisitions, staff transfers, staff reductions, etc.).

These ad hoc consultations (provided for in the French Labor Code) require intense preparation and follow-up, which we generally carry out in project mode for better incorporation of our work into the client’s processes.

We also provide support in situations involving expert investigations (into the financial statements, or into health, safety, and working conditions, for example), the negotiation of agreements, the triggering of alerts, as well as lawsuits, etc. Lastly, we also provide support for the long-term follow-up of alerts regarding psychosocial risks.
